IT'S A NUMBER'S GAME: Minority unions: Obtaining organisational rights, 189A retrenchment consultations, and collective agreements.

This talk will address the following questions:

  • What right does a minority union have to claim organisational rights?

  • Can a minority union embark on strike action to obtain organisational rights?

  • Is there an obligation to consult minority unions in retrenchment consultations?

  • Can a minority union, as a non-party to a collective agreement, refer a dispute in terms of Section 24 of the LRA?

Francois du Toit has extensive experience in Labour Law as a CCMA Commissioner.
